In this course, taught by a licensed Pennsylvania attorney, you will draft an advance health care directive (Medical Power of Attorney + Living Will). You will learn about the difference between a medical power of attorney and a living will. You will learn about the powers and obligations you can give your agent, and when the state may override the provisions of your document. Each paragraph of the document will be explained in detail as you complete the document yourself. You will learn who may serve as an agent, who may help you sign the document if you cannot do so yourself, and how you can revoke the document if you later change your mind.
For agents, you will learn the steps you are required to take to comply with the statutorily imposed "due diligence"and "fiduciary duty" obligations. You will learn about your rights and duties and ways in which you can best serve someone who put you in charge. You will learn about the different steps you must take depending upon whether you must make a decision concerning routine care, surgical procedures, or end of life care.
For health care workers, you will learn about your legalduties in both caring for the patient and in making notations in the patient's medical records. You will learn about your duties if you cannot comply with the wishes of the patient or agent.You will also learn the options that are available to you if you disagree with a decision of the patient or the other caregivers regarding end of life care, including your right not to be discriminated against because ofyour decision. You will learn who can make decisions on behalf of a patient if an Advance Health Care Directive is revoked, or if the agent is no longer available.
If you are a senior enrolled inMedicare, you may be able to receive this course at a reduced cost or no cost as part of your annual wellness exam (appliesif you have not yet had a discussion about "end of life issues"with your medical provider).
